
PARTICIPANT AGREEMENT DECLARATION
You warrant, declare and acknowledge that:

The information given by you in entering this agreement is correct and will be relied upon by us.

Our staff, agents and subcontractors are not medically trained and should you have any concerns with your health and fitness you should seek independent medical advice before engaging in any physical activity on our premises.

To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, well being or physical condition. Further, that you will advise us immediately should your health or vulnerability to injury change.

You have read and understood this agreement and all of its the Terms and Conditions before accepting them below.

This agreement will become binding upon both parties once the CONFIRM PAYMENT" button has been clicked.

If you have a medical condition which will benefit from regular exercise, your GP has signed this off and recorded this on your medical records.
You are primarily responsible for your health and wellbeing, but we at Apex Boutique Gym are concerned that you enjoy our facilities safely. To that end we consider that we should expect the following of each other.

We shall endeavor to maintain a safe environment for you to enjoy your exercise.

We shall endeavor to ensure that our Fitness trainers and staff are qualified to fitness industry standards.

We shall at all times keep confidential any information that you give us regarding your health.

You must complete the Apex online par Q before your first session.
TERMS OF BOOKING
You warrant, declare and acknowledge that:

All bookings are non refundable

Personal Training memberships allow 6 week advanced booking in order to help you to secure a regular session.

One Off Sessions are booked at time of purchase.

Exercise levels will be progressive and regulated by the trainer.

By agreeing to participate in Apex Boutique Gym 1:1 / 2:1 and group exercise classes you are agreeing to follow the guidelines set out by your trainer throughout the duration of the training programme.

A minimum 24 hour cancellation policy applies to scheduled sessions. (Excludes course bookings)

Sessions cancelled less than 24 hours in advance will be charged in full to the client and not carried forward. (see covid-19 measures for exemptions to this)

If your personal trainer / group trainer is absent due to holiday or sickness, that session will be covered by a trainer of the same or higher level. If this is not possible, your session will be refunded or rescheduled.

Sessions will not be extended due to lateness of the client or due to interruptions caused by the client.

Sessions must be paid for in advance before the session commences via our online booking system.

Refunds will not be given due to illness, injury or non participation. (see covid-19 measures for exemptions)

Client discounted rate is available on PT sessions for PT clients that have a monthly membership.

Rates and prices can vary at any time at the discretion of Apex Boutique Gym.

All events available on the community health and fitness programme are independent events and are in no way associated with Apex boutique Gym. These events are run by external parties who have an agreement with Apex Boutique Gym based on our working room hire agreement.
By signing up for membership, you agree to the following Terms and Conditions to ensure the safety and well-being of yourself and others while using our facilities.
1. General Conduct and Behavior
As a member of Apex BoutiqueGym, you are expected to conduct yourself in a manner that is respectful to all other members, guests, and staff. This includes following gym rules, using equipment responsibly, and maintaining good personal hygiene.
2. Use of the Facility
By using the gym, you acknowledge that the facility is designed for safe physical activity and wellness. Members should exercise caution and consult with a medical professional if they have any health concerns that could affect their ability to safely use the gym.
3. Prohibited Substance Use
For your safety and the safety of others, members are strictly prohibited from using the gym while under the influence of any substance that impairs their physical or mental abilities. This includes, but is not limited to:
• Alcohol: Consumption of alcohol is strictly prohibited before or during exercise in the gym.
• Drugs: Any illegal drugs, as well as the misuse of prescription drugs, are prohibited. This includes substances that may impair motor skills, judgment, or coordination.
• Medications: If you are taking medication that may impair your ability to safely exercise (e.g., sedatives, painkillers, or stimulants), we strongly recommend consulting a healthcare provider prior to using the gym. Medications that cause drowsiness, dizziness, or decreased coordination are of particular concern.
Examples of substances that may impair exercise include:
• Narcotic pain relievers (e.g., morphine, oxycodone)
• Antidepressants and anti-anxiety medications (e.g., benzodiazepines like Xanax)
• Alcoholic beverages
• Stimulants (e.g., cocaine, methamphetamines)
• Cannabis (including medical marijuana, where applicable by law)
• Sedatives and sleeping aids (e.g., benzodiazepines, barbiturates)
It is your responsibility to be aware of how medications or other substances may affect your ability to safely perform physical activities. If in doubt, consult a medical professional before engaging in exercise.
4. Medical Consultation
If you are taking prescription medication or have a medical condition that may interfere with your ability to safely exercise, please consult with a healthcare provider prior to using the facility. Members who experience any adverse effects during exercise (such as dizziness, nausea, or disorientation) should immediately stop exercising and seek medical assistance if necessary.
5. Consequences for Non-Compliance
If any member is found to be under the influence of alcohol, drugs, or medication that impairs their ability to safely exercise, they may be asked to leave the premises immediately. In cases of repeated or severe violations, membership may be suspended or terminated without refund.
6. Liability Waiver
By using the gym facilities, you acknowledge that you are in good health and capable of safely engaging in physical exercise. Apex Boutique Gym is not liable for any injuries sustained while exercising under the influence of drugs, alcohol, or impairing medication.
7. Amendments
Apex Boutique Gym reserves the right to modify these Terms and Conditions at any time. Members will be notified of any significant changes, and continued use of the gym will constitute acceptance of the revised Terms and Conditions.
